Terms of Service

Please read these Terms of Service ("Terms") carefully before using the services or website of Eco Moves LA ("Company," "we," "us," or "our"). By booking our services or using our website, you agree to be bound by these Terms.

1. Services

Eco Moves LA provides short-term rental of reusable plastic moving totes and hand dollies ("Equipment") for residential and commercial moving purposes within the greater Los Angeles area. Services include delivery and pickup of Equipment to and from addresses specified by the customer.

2. Eligibility

You must be at least 18 years of age to book our services. By booking, you represent that you are of legal age and have the authority to enter into this agreement.

3. Bookings & Payment

• All bookings must be made through our online booking form at ecomoves.netlify.app/booking.html or via our Facebook page.
• Bookings are not confirmed until payment is received in full.
• Payment is accepted via Venmo, Zelle, or Cash App. Payment instructions will be provided after your booking is submitted.
• Rental prices are as published on our website. Delivery and pickup fees are quoted separately based on your location.
• All sales are in US Dollars.

4. Delivery & Pickup

• Delivery and pickup services are available for a fee quoted at the time of booking based on your location.
• We will make reasonable efforts to deliver and pick up Equipment at the agreed times. Delivery windows are confirmed by text message.
• Customer must be available at the delivery address at the agreed time, or make arrangements for someone 18+ to receive the Equipment.
• If we are unable to complete delivery due to customer unavailability after two (2) attempts, a redelivery fee of $25 may apply.
• Pickup must be scheduled within the rental period. Failure to have Equipment available for pickup will result in extension fees as described in the Rental Agreement.

5. Rental Period & Extensions

• The standard rental period is seven (7) days from the date of delivery.
• Extension requests must be made at least 24 hours before the scheduled pickup date.
• Extension fees: 20-tote — $10/day or $50/week; 40-tote — $15/day or $75/week; 60-tote — $20/day or $100/week.
• Unauthorized extensions (failure to have Equipment ready on pickup date without prior notice) will be charged extension fees retroactively.

6. Customer Responsibilities

By booking our services, Customer agrees to:

• Use Equipment only for lawful residential or commercial moving purposes.
• Not overload Totes beyond their rated capacity (approximately 70 lbs per tote).
• Protect Equipment from theft, vandalism, and damage.
• Return all Equipment clean and free of damage at the time of pickup.
• Provide accurate delivery and pickup addresses. Customer is responsible for additional charges resulting from incorrect address information.

7. Loss, Damage & Replacement Fees

• Customer is responsible for all Equipment from delivery until pickup.
• Lost or unreturned totes: $15.00 per tote.
• Cracked, broken, or otherwise damaged totes: $15.00 per tote.
• Lost or damaged hand dolly: $50.00.
• Damage assessments will be communicated within 48 hours of pickup. Payment of damage fees is due within 7 days of notification.

8. Cancellation & Refund Policy

• Cancellations made 48 or more hours before the scheduled delivery receive a full refund.
• Cancellations made less than 48 hours before scheduled delivery are subject to a 50% cancellation fee.
• No-shows (refusal of delivery or failure to be present without prior cancellation) forfeit 100% of the rental fee.
• Refunds will be issued via the same payment method used, within 5–7 business days.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Eco Moves LA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damage to property, personal injury, or financial loss arising from your use of our services or Equipment.

Our total liability to you for any claim arising from these Terms or our services shall not exceed the total amount paid by you for the specific rental giving rise to the claim.

10. Disclaimer of Warranties

Equipment is provided "as is." While we take care to provide clean, functional Equipment, we make no warranties, express or implied, regarding the fitness of Equipment for any particular purpose beyond its intended use as a moving tote.

11. Indemnification

You agree to indemnify, defend, and hold harmless Eco Moves LA and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.

12. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted to our website with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or our services shall be resolved in the courts of Los Angeles County, California.
